6.1 RightsClaimConflictNotification

The RightsClaimConflictNotification has been developed to communicate data when two or more parties have made a claim in respect of the same resource and the sum of the right share claims exceeds 100%.

When a music licensing company detects a rights conflict of this nature in its territory it may notify all conflicting parties that made a claim in respect of the same resource by sending a RightsClaimConflictNotification message (Arrow 1 in Figure 1). This may also be sent to a third-party facilitator acting on behalf of one or more of the claiming parties now in conflict.

Each RightsClaimConflictNotification is intended to contain data about the claim conflicts which are specific to each recipient. Each message may therefore contain several Records, each of which defines all the current claim conflicts for a specific time period for that conflicting party as identified by the music licensing company. While the data contained in the message is therefore different for each recipient, all conflicting parties with an interest in an individual conflicting rights claim shall receive the same data about that conflicting rights claim. The Record used for this purpose is defined in Clause 9.3.

While the data about the conflicting rights claim itself will be the same, the Record shall contain data that may differ for each of the conflicting parties in the sequence in which the conflicting parties are listed for each of the conflicting rights claims (see Clause 9.3.2). Similarly, the data defining the action expected by the conflicting party in receipt of the RightsClaimConflictNotification may differ for each of the conflicting parties (see Clause 9.3.3).
